Thank you for your interest in our website www.schwimmschule-herrmann.com (“website”). The protection of your privacy and the lawful collection, processing and use of your data is particularly important to us.
In the following, we will inform you which of your data we collect on the website and for what purposes we process and use it.

1.    Data controller/service provider

2.    Data collection, data processing and data use when visiting our website

2.1.    When using the website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data which your browser transmits to our server. If you wish to view our website, we collect the following data, which is technologically necessary for us to display our website to you and to ensure stability and security:

- name of your internet service provider,
- IP address allocated to you,
- address of the website from which you visit our website,
- browser used and, if applicable, operating system of your device,
- transmitted data volume,
- subpages of our website visited by you, and
- date and time of your visit to our website.

2.2.    This log file information is stored for 8 weeks for security reasons (e.g. to investigate abuse). After 7 days, however, the IP address is made anonymous. Insofar as further storage of the data is necessary for the purpose of evidence, it will only be deleted after final clarification of the respective incident.

2.3.    This data is processed by us for the following purposes:
-    guaranteeing a smooth connection of the website,
-    guaranteeing comfortable use of our website,
-    evaluation of system security and system stability, as well as
-    for other administrative purposes.

2.4.    Legal basis for data processing is Art. 6 (1) sentence 1 (f) GDPR. Our legitimate interest follows from the purposes for data collection listed above.

2.5.    We as well as our host provider, whose servers are located in the European Union, have access to the data.

3.         1&1-WebAnalytics

3.1.      On our website we use 1&1-WebAnalytics, a web analysis service of 1&1 Internet SE, Elgendorfer Straße 57, 56410 Montabaur (hereafter “1&1”).

3.2.      1&1 evaluates the user behaviour on our website for us via its 1&1-WebAnalytics service and logs the following usage data:
-  Referrer (previously visited website)
-  Requested website or file
-  Browser type and browser version
-  Operating system used
-  Type of device used
-  Time of access
-  IP address in anonymised form (used only to determine the location of access)


3.3.      According to 1&1, cookies are not used. Information about the use of our websites is transmitted to a 1&1 server and stored there anonymously. 1&1 compiles anonymous reports for statistical evaluation of the website activities using the determined usage data. Furthermore, the data serves the optimisation of the website. Your IP address will be made anonymous according to 1&1 and will only be processed further in shortened form. Our legitimate interest arises from economic aspects and the above-mentioned purpose of data processing. The data is deleted if it is no longer required for analysis. The legal basis for data processing is Art. 6 (1) sentence 1 (f) GDPR.

4.    Data collection, data processing and data use when contacting us

4.1.    We collect your data when you contact us via the contact form or by e-mail. The processing and use of your – voluntarily – provided data when contacting us is exclusively for the purpose of responding to your request and for any queries. We delete the data arising in this context after the storage is no longer necessary, or restrict the processing if statutory retention obligations exist.

4.2.    Data processing ensues with the purpose of contacting us in accordance with Art. 6 (1) sentence 1 (b) GDPR.

5.    Transfer of data

5.1.    Your personal data will not be transmitted to third parties for purposes other than those listed below.

5.2.    We only pass on your personal data to third parties if:
-    you have given your express consent in accordance with Art. 6 (1) sentence 1 (a) GDPR,
-    the transfer according to Art. 6 (1) sentence 1 (f) GDPR  is necessary to assert, exercise or defend legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
-    in the event that a legal obligation exists for the transfer in accordance with Art. 6 (1) sentence 1 (c) GDPR, and
-    this is legally permissible and necessary for the processing of contractual relationships with you in accordance with Art. 6 (1) sentence 1 (b) GDPR.

6.    Data processing for applications

6.1.    If you apply to us in response to job advertisements or make an unsolicited application, we process the data provided by you in the context of your application for the purposes of the application procedure. If we conclude an employment contract with an applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions (legal basis is Sect. 26 (1) in connection with (8) sentence 2 Federal Data Protection Act, if applicable). If we are unable to offer you a position after completion of the application procedure, the application documents will be deleted two months after notifying you about the rejection, provided that no other legitimate interests on our part stand in the way of deletion. A legitimate interest in this sense is, for example, a duty to provide evidence in proceedings under the General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz, AGG) (legal basis for this is Art. 6 (1) (f) GDPR).

6.2.    In the event that you have given your consent to the continuous storage of your data in writing or in electronic form, we may process and use your data even after completion of the application procedure. The legal basis for this is Art. 6 (1) sentence 1 (a) GDPR. The data will be processed and used to enable us to contact you for professional purposes and for possible consideration for future vacancies. The revocation of a given consent is possible at any time and without providing justification with effect for the future. In the event of revocation, your data will no longer be taken into account when filling vacancies. Your data will then be deleted in accordance with the statutory provisions.

7.    Links to other websites

Our website contains links to the websites of third parties. If you click on such a link, we unfortunately no longer have any influence on the collection, processing and use of your data by third parties. For this reason, we cannot accept any responsibility.

8.    Rights of data subjects

You have the right

-    in accordance with Art. 15 GDPR to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if this has not been collected by us, and the existence of automated decision-making including profiling and, if applicable, meaningful information regarding their details;

-    in accordance with Art. 16 GDPR, to request the immediate completion or correction of incorrect personal data stored with us;

-    in accordance with Art. 17 GDPR, to demand the erasure of your personal data stored by us, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;

-    in accordance with Art. 18 GDPR, to demand the restriction of the processing of your personal data if you dispute the accuracy of the data, if the processing is unlawful but you refuse its erasure and we no longer require the data, but if you need it to assert, exercise or defend legal claims or if you have filed an objection against the processing in accordance with Art. 21 GDPR;

-    in accordance with Art. 20 GDPR, to receive the personal data you have provided to us in a structured, common and machine-readable format or to request its transfer to another person responsible;

-    in accordance with Art. 7 (3) GDPR, to revoke your consent to us at any time. As a result, we are no longer allowed to continue processing data based on this consent in the future and

-    in accordance with Art. 77 GDPR, to complain to a supervisory authority. Generally, you can contact the supervisory authority of your usual place of residence or workplace or our office.

9.    Right to object

If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 (1) sentence 1 (f) GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons for this arising from your particular situation.
